2. Scope
These Terms and Conditions govern all distance sale contracts concluded between Pedro Sacadura and the consumer through this website.
3. The Works
All works presented on this website are original creations by Pedro Sacadura.
Each print is:
Produced on demand (made-to-order)
Issued as part of a limited edition, as specified per artwork
Produced with the inherent characteristics of fine art printing
Slight variations in tone, colour, and texture may occur due to the nature of the materials and printing processes used. Such variations, provided they do not constitute a lack of conformity, shall not give rise to any claim.
4. Editions
Each artwork may be released in limited quantities. Once an edition is sold out, it will not be reproduced in the same format.
Pedro Sacadura reserves the right to produce the same image in different formats or sizes, unless expressly stated otherwise in the artwork description.
5. Intellectual Property
All works are the exclusive intellectual property of Pedro Sacadura. The purchase of a print does not entail any transfer of copyright.
Without prejudice to the rights conferred upon the purchaser by applicable Portuguese copyright law:
Any reproduction, distribution, publication, communication to the public, display, use on social media, advertising use, or any other commercial exploitation of the works is strictly prohibited without the prior written consent of Pedro Sacadura;
The moral right of authorship is inalienable and non-waivable: the author's name must always be associated with the work, regardless of the medium or context in which it is presented;
The right to the integrity of the work remains with the author; the work may not be altered, distorted, or used in any manner that is offensive to the author's reputation.
Resale royalty right (droit de suite): Under applicable law, the author of a graphic or plastic work of art is entitled to a share of the price obtained in each subsequent sale of the work carried out with the involvement of professional art market agents, following the initial transfer by the author. This provision does not apply to resales between private individuals outside the art market.
6. Orders and Production
Since each print is produced on demand:
a) Personalised prints (where the buyer selects size, substrate, finish, or other specifications): these are produced in accordance with the consumer's specifications or are clearly personalised, and therefore the right of withdrawal does not apply, pursuant to Article 16(c) of Directive 2011/83/EU and the applicable transposing legislation.
b) Catalogue prints without personalisation (standard format and substrate available on the website without additional configuration): in these cases, the right of withdrawal set out in Clause 9 below may apply.
The production lead time is typically 3 to 7 business days, after which the order is dispatched.
7. Prices and Taxes
All prices are listed in euros (€) and include VAT at the applicable rate in force in Portugal.
For international customers:
The payment service provider may apply a currency conversion
Any taxes, customs duties, or import fees applicable in the destination country are the sole responsibility of the buyer
Shipping costs are calculated and displayed to the buyer during the checkout process, before the order is finalised
8. Shipping and Delivery
Shipping is available worldwide.
Estimated delivery times after dispatch are, by way of indication:
Mainland Portugal: 2 to 5 business days
Europe: 5 to 10 business days
Rest of the world: 10 to 20 business days
Unless otherwise agreed, the maximum delivery period is 30 days from the date of conclusion of the contract. If the order cannot be delivered within this period, the buyer will be informed and may, if they so wish, withdraw from the contract with the right to a full refund.
Pedro Sacadura is not responsible for delays caused by:
Shipping carriers
Customs clearance
External events beyond its control (force majeure)
All prints are carefully packaged to ensure safe delivery.
9. Right of Withdrawal
The consumer has a period of 14 calendar days to exercise the right of withdrawal and return the goods, without giving any reason and without incurring any costs other than those provided for by law.
This period begins on the day on which the consumer, or a third party designated by the consumer (other than the carrier), takes physical possession of the goods.
Exception — Personalised prints: The right of withdrawal does not apply to the supply of goods made to the consumer's specifications or clearly personalised.
Exercising the right: To exercise the right of withdrawal, the buyer must communicate their unequivocal decision to Pedro Sacadura within the statutory period by:

The consumer is responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
10. Legal Guarantee of Conformity
The consumer benefits from the legal guarantee of conformity provided under applicable law. In the event of a lack of conformity of a delivered good (including manufacturing defects, transit damage not attributable to the buyer, or delivery of a product different from the one ordered), the buyer is entitled, under applicable legislation, to:
Repair or replacement of the good
A price reduction or termination of the contract, where repair or replacement is not possible or is not carried out within a reasonable time
11. Alternative Dispute Resolution
In the event of a dispute, the consumer may have recourse to the Alternative Dispute Resolution (ADR) entities legally recognised in Portugal.

For cross-border disputes, the consumer may also use the European Online Dispute Resolution (ODR) Platform, available at: https://ec.europa.eu/consumers/odr
12. Limitation of Liability
To the fullest extent permitted by applicable law, Pedro Sacadura shall not be liable for any indirect, incidental, or consequential damages arising from the use or purchase of the works.
Nothing in these Terms and Conditions limits or excludes any rights the consumer may have under applicable mandatory consumer protection legislation, including the statutory guarantee and withdrawal rights provided by law.
13. Governing Law and Jurisdiction
These Terms and Conditions are governed by Portuguese law.
For the resolution of disputes, the court of the consumer's domicile in Portugal shall have jurisdiction, without prejudice to the rights conferred upon the consumer by law regarding the choice of competent court. For consumers domiciled outside Portugal, the rules on international jurisdiction set out in Regulation (EU) No 1215/2012 shall apply.
14. Order Confirmation
Following the conclusion of the distance contract, Pedro Sacadura will confirm the conclusion of the contract on a durable medium (by email) within five days of its conclusion and, at the latest, at the time of delivery of the goods. Such confirmation includes the pre-contractual information required by law or refers to the location where that information is available.
